Immunity Be Damned: Justice Department Files Revised Trump Indictment in Jan. 6 Case

The right-wing majority on the Supreme Court dealt democracy a blow this summer with their brazenly unconstitutional ruling that presidents – especially the deranged felon who appointed three of them – are immune from prosecution for "official" acts, whatever that means. They also threw a monkey wrench into the Justice Department's twin criminal cases against Donald Trump, one filed in Florida for stealing and mishandling classified documents on his way out of the White House, and the other filed in Washington, DC, for trying to overturn Joe Biden's 2020 victory at the polls using fraudulent state electors and a large violent mob aimed at the Capitol. Special counsel Jack Smith has led both of those prosecutions, and he has not been deterred by the corrupt Supreme Court's campaign of interference on behalf of a convicted criminal and wannabe dictator.

Yesterday Smith's team filed a superseding indictment against Trump in the DC case revolving around his Jan. 6, 2021 coup attempt. The revised charges were presented to a new grand jury that was hearing the evidence for the first time. "Perhaps the most significant change" in the new indictment, the New York Times reports, "was that Mr. Smith's deputies removed all allegations concerning Mr. Trump's attempts to strong-arm the Justice Department into supporting his false claims that the election had been rigged against him. ...

The revised indictment also removed references to Mr. Trump's conversations with his White House aides and lawyer.
But it retained extensive accounts of his interactions with Vice President Mike Pence and his staff — repeatedly emphasizing that Mr. Pence was also Mr. Trump's running mate and that Mr. Trump wanted him to act in his ceremonial capacity as president of the Senate, a role that arguably placed him beyond the reach of core executive branch powers and responsibilities.

This is how Smith hopes to work around the immunity the Supreme Court invented for "official" presidential acts. Inshallah it will be enough to secure an eventual conviction before that hideous ruling can be overturned.

Meanwhile in another federal courtroom in DC, a judge sentenced the first MAGA foot soldier to breach the Capitol on Jan. 6, 47-year-old Michael Sparks of Cecilia, Kentucky, to four years and five months in prison. "We're getting in that building," he said on video during the insurrection, to which he wore a tactical vest. "All it's going to take is one person to go [inside.] The rest is following." After his conviction, Sparks told the judge he still believes Trump's lies about that election. What can you say about a person who throws their life away for a crooked politician who calls his supporters "basement dwellers" behind their backs? He isn't beating the loser charges.
